The attorney general of Vermont says more is at stake in an appeal of a federal court ruling than the future of the Vermont Yankee nuclear power plant.
At issue is how federal courts can consider “legislative intent” when deciding cases. And that can have nationwide implications far beyond the regulation of the nuclear power industry.
With the support of Governor Peter Shumlin(D), the Vermont attorney general is appealing a recent federal court ruling that says Vermont can not use new law to supersede federal authority over the nuclear power industry.
